This Privacy Policy describes how Octayne Technologies, Inc. collects, uses, discloses, and protects personal information when you use Octayne PSA and related services.

1. Who We Are

Octayne Technologies, Inc. (“Octayne,” “we,” “us,” or “our”) is a Texas-based company that operates the Octayne PSA platform (the “Service”). For privacy inquiries, contact support@octayne.ai.

By using the Service, you acknowledge this Privacy Policy. If you do not agree, do not use the Service.

2. Information We Collect

2.1 Information You Provide

  • Account information: name, email address, password, company name, and role.
  • Billing information: credit card details and billing address, processed via Stripe; Octayne does not store full card numbers.
  • Customer Data: time entries, project data, client records, expense reports, and other operational data you enter into the Service.
  • Communications: messages you send us (support tickets, emails, feedback).

2.2 Information Collected Automatically

  • Usage data: pages visited, features used, timestamps, actions taken.
  • Device data: IP address, browser type and version, operating system, device identifiers.
  • Log data: server logs including access times, API calls, and error reports.
  • Cookies and similar technologies: see Section 6.

2.3 Information from Integrations

When you connect third-party services such as QuickBooks, Jira, Microsoft 365, or Google, Octayne receives the data those services share based on the permissions you grant. Typical data includes accounting records, project tickets, calendar events, and user identity.

3. How We Use Information

Octayne uses personal information to:

  • Provide, operate, maintain, and improve the Service.
  • Process transactions and send related communications (receipts, renewals, service notices).
  • Authenticate users and secure accounts.
  • Provide customer support and respond to requests.
  • Send service-related announcements and marketing communications (you can opt out of marketing at any time).
  • Analyze usage patterns to improve the Service, in aggregated and de-identified form.
  • Detect, prevent, and respond to fraud and security incidents.
  • Comply with legal obligations and enforce our Terms of Service.

4. Legal Bases for Processing

For individuals in the European Economic Area, United Kingdom, or Switzerland, Octayne's legal bases for processing personal data are:

  • Contract: processing necessary to provide the Service under our Terms.
  • Legitimate interests: improving the Service, fraud prevention, security, and business operations, balanced against your rights.
  • Consent: where required, for marketing communications and optional cookies. You may withdraw consent at any time.
  • Legal obligation: where processing is required by law.

5. How We Share Information

Octayne does not sell personal information. We share it only as follows:

5.1 Sub-Processors and Service Providers

Octayne engages third-party service providers (“sub-processors”) who process data on our behalf:

  • Amazon Web Services (AWS): cloud hosting and infrastructure.
  • Stripe: payment processing.
  • Additional sub-processors may be added from time to time; an updated list is available on request at support@octayne.ai.

All sub-processors are bound by contractual obligations to protect personal information.

5.2 Third-Party Integrations

When you connect an integration (QuickBooks, Jira, Microsoft 365, Google, etc.), data is shared with the third party per your configuration. These services operate under their own privacy policies.

5.3 Legal and Safety

Octayne may disclose information to comply with laws, legal process, or government requests, or to protect the rights, property, or safety of Octayne, our users, or others.

5.4 Corporate Transactions

In the event of a merger, acquisition, or sale of assets, personal information may be transferred to the acquiring entity, subject to the confidentiality obligations in this policy.

6. Cookies and Tracking Technologies

Octayne uses cookies and similar technologies for:

  • Strictly necessary: authentication, security, and core functionality.
  • Analytics: understanding how users interact with the Service.
  • Preferences: remembering your settings.

You can control cookies through your browser settings. Disabling necessary cookies may impair the Service.

7. Third-Party Integrations

When you authorize a third-party integration, the relevant third-party service accesses data according to the scopes you grant. You can revoke access either within the Service or within the third party's settings. Octayne is not responsible for third-party services' privacy practices.

8. International Data Transfers

Octayne is based in the United States, and currently processes personal data in the U.S. If personal information is transferred from other jurisdictions (including the EEA, UK, or Switzerland), Octayne relies on appropriate safeguards such as the EU Standard Contractual Clauses.

9. Data Retention

Octayne retains personal information for as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. Customer Data is deleted or anonymized within 60 days of account termination, except as required by law.

10. Data Security

Octayne implements administrative, technical, and physical safeguards to protect personal information, including encryption in transit and at rest, access controls, logging, and regular security reviews. No method of transmission or storage is 100% secure, but we continuously improve our practices.

11. Your Rights

Depending on your jurisdiction, you may have the following rights:

  • Access: request a copy of personal information Octayne holds about you.
  • Correction: request correction of inaccurate or incomplete data.
  • Deletion: request deletion (“right to be forgotten” / “right to delete”).
  • Portability: receive your data in a structured, machine-readable format.
  • Restriction or Objection: restrict or object to certain processing.
  • Withdraw Consent: withdraw consent where processing is based on consent.
  • Non-Discrimination: not be discriminated against for exercising privacy rights (CCPA).

To exercise these rights, contact support@octayne.ai. Octayne may need to verify your identity. We will respond within the time required by applicable law (typically 30 days for GDPR, 45 days for CCPA).

11.1 California Residents (CCPA / CPRA)

You have specific rights under the California Consumer Privacy Act to know, delete, correct, and opt out of the sale or sharing of personal information. Octayne does not sell personal information.

12. Children's Privacy

The Service is not directed to individuals under 16. Octayne does not knowingly collect personal information from children under 16. If you believe we have collected such information, contact support@octayne.ai and we will delete it.

13. Changes to This Policy

Octayne may update this Privacy Policy from time to time. Material changes will be announced via email or through the Service at least 30 days in advance. Continued use of the Service after the effective date constitutes acceptance.
